Terms of Service

By creating an account or using MarkerX ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and MarkerX.

MarkerX is a web-based application that:

• Accepts uploads of blood test result documents in PDF format
• Extracts numerical blood marker values from those documents using AI
• Displays those values alongside published reference ranges for informational purposes
• Provides plain-English explanations of blood markers and general health information
• Allows users to track marker values over time
• Provides AI-generated responses to questions about blood test results (Pro feature)

• MarkerX is NOT a medical device.
• MarkerX does NOT provide medical advice, diagnosis, or treatment.
• The information provided by MarkerX is for general informational and educational purposes only.
• Reference ranges displayed in MarkerX are drawn from published population studies and research literature. They are provided for informational context only and should not be used as the sole basis for any health decision.
• AI-generated responses in MarkerX are informational only. They are not reviewed by a medical professional and do not constitute clinical advice.

Always consult a qualified, registered healthcare professional (doctor, specialist, or relevant clinician) before making any decisions based on your blood test results or the information provided by MarkerX.

If you are experiencing a medical emergency, contact emergency services immediately.

• You must be at least 18 years of age to use MarkerX
• You must provide accurate information when creating your account
• You are responsible for maintaining the security of your account credentials
• You may not create accounts on behalf of others without their explicit consent

By using MarkerX you agree that:

• You will upload only your own blood test results, or results you have explicit authorisation to upload
• You will not use MarkerX as a substitute for professional medical advice or clinical care
• You will not rely solely on MarkerX output when making medical or health decisions
• You will not attempt to reverse-engineer, scrape, or extract data from the Service in bulk
• You will not use the Service for any unlawful purpose
• You will not share your account credentials with other people

By uploading a blood test document to MarkerX, you:

• Confirm you have the right to upload and process the document
• Grant MarkerX a limited licence to process the document solely for the purpose of extracting your marker values
• Acknowledge that the original PDF will be permanently deleted after extraction (see our Privacy Policy)
• Understand that extracted marker values will be stored in your account until you delete them or close your account

• Subscriptions are billed monthly in advance via Stripe
• You may cancel at any time from Settings → Account → Manage Subscription
• Cancellation takes effect at the end of the current billing period — you retain Pro access until then
• We do not offer refunds for partial billing periods except where required by applicable consumer law
• If payment fails, your account will revert to the free tier after a grace period

MarkerX owns all intellectual property in the Service, including the software, design, reference range database, marker descriptions, and content. You may not copy, reproduce, or distribute any part of the Service without written permission.

Your blood marker data remains your own. We do not claim ownership of your health data.

MarkerX's total liability to you for any claims arising from use of the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or $50 USD, whichever is greater.

You agree to indemnify and hold harmless MarkerX, its officers, employees, and contractors from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

• The Service is provided "as is" and "as available" without warranties of any kind
• We do not warrant that marker extraction will be accurate for all lab report formats
• Reference ranges are provided for informational purposes and may not apply to your individual circumstances
• AI-generated content may contain errors and should not be relied upon for medical decisions
• We reserve the right to modify, suspend, or discontinue any part of the Service at any time

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or use of the Service shall be subject to the exclusive jurisdiction of the courts of Australia.

If you are a consumer in another jurisdiction, you may also have rights under the laws of your own country that cannot be excluded. For users in Australia, these Terms do not exclude rights under the Australian Consumer Law that cannot be excluded by contract.

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of MarkerX after that date constitutes acceptance of the updated Terms.

We reserve the right to suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or use the Service in a way that could harm other users or MarkerX.

You may terminate your account at any time from Settings → Account → Delete Account.
